Al\u00a0<strong><em>Ofi\u021ber de conformitate<\/em><\/strong>\u00a0los empleados, accionistas, socios \u0219i\/sau terceros le hacen llegar las reclamaciones relativas a un posible incumplimiento de los c\u00f3digos de conducta de la sociedad \u0219i\/sau de las leyes aplicables.<\/p>\n<p>El\u00a0<strong><em>Ofi\u021ber de conformitate<\/em><\/strong>\u00a0ha de ser totally independiente y ha de contar con medios suficientes para poder aplicar correctamente el programa de\u00a0<strong><em>Respectarea<\/em><\/strong>. \u00cen cazul \u00een care societatea nu are obliga\u021bia de a face audit, administratorul poate \u00eendeplini aceast\u0103 func\u021bie. Cu toate acestea, nu este recomandabil, deoarece se pot genera situa\u021bii de conflict de interese etc. Nu trebuie s\u0103 uit\u0103m c\u0103 dac\u0103 responsabilul programului de\u00a0<strong><em>Respectarea<\/em><\/strong>\u00a0no tiene independencia entonces el programa no se considera eficiente y el resultado es que no servir\u00eda como eximente penal.<\/p>\n<p><strong>Concluz\u00e2nd<\/strong>, contar con un programa de\u00a0<strong><em>Conformitate corporativ\u0103<\/em><\/strong>\u00a0aportar\u00e1 beneficios a su organizaci\u00f3n. Cu toate acestea, nu trebuie s\u0103 v\u0103 l\u0103sa\u021bi prad\u0103 tenta\u021biei \u0219i s\u0103 achizi\u021biona\u021bi programe de\u00a0<strong><em>Respectarea<\/em><\/strong>\u00a0&#8222;a granel&#8221; ya que el programa ha de ser un programa a medida para que sea eficiente.
